Rental
Deposit
Rental deposits are non refundable;
however, you may use your $50 rental deposit on another rental at any time
within 1 year. Rental deposits are deducted from your total rental price
at time of delivery. Unforseen weather conditions will not be cause
for a refund. We will work with you to keep you as a satisfied
customer. Once unit has been delivered and set up there are NO refunds.
Fees
Aim High Moonwalks reserve the right to
assess a cleaning fee if the unit is in bad condition upon pick up. We do
not allow silly string, food, drinks, or pets in the unit at any time. You
WILL
be charged a cleaning fee of $35 and up if our unit has been misused according to our contract
agreement. We do appreciate your business and we do want to continue renting
extremely clean and well kept units.
Payment
We gladly accept Cashiers Checks, Money
Orders, Wire Transfer, Visa or MasterCard. ( we no longer accept American
Express ) for all moonwalk
purchases. We do require 1/2 down deposits on all items at time of
order. Final balance due must be paid prior to shipping with one of the
above mentioned verified U.S funds.
Payments for rentals are made in CASH ONLY
upon delivery of the unit. You may make prior arrangements to pay for your
rental using a major credit card prior to your delivery date.
Shipping
Shipping is to be paid at the time of
delivery to the Freight company. Freight is always the sole responsibility
of the buyer, including all costs and expenses relating to shipment, including
insurance, customs expenses, duties, taxes, etc. shall be the sole
responsibility of Buyer. We will provide you with a Tracking Number upon
request.
Delivery
The
promised delivery date is only an estimate based on current and anticipated
factory time of when the order will be shipped. Aim High Moonwalks; herein
referred to as "AHM" shall not be liable for damage or for delay
in delivery arising from causes beyond its control and without its fault or
negligence including, but not limited to, destruction or damage to the goods,
raw material shortage, unforseen acts of God, , act of government entities,
fires, floods, strikes, freight embargoes and severe weather. If the delay is
caused by the delay or default of a subcontractor of Aim High Moonwalks and if
such delay arises from causes beyond the control of both AHM and the
subcontractor, AHM shall not be liable to Buyer for damages to the unit during
transport or misuse of the unit. Due to high cost of
Gasoline there may be a delivery charge assessed to your rental
depending upon your area or location.
Goods
Inspection
Buyer
shall inspect the goods promptly after receipt. Any claim of shortage, breach of
warranty, damage, or defect, which would be observable upon reasonable
inspection of the goods, is waived by Buyer unless Buyer submits claim in
writing to Aim High Moonwalks within Five (5) days of receipt of the
merchandise. Failure of Buyer to give written notice of a claim within this
inspection time period shall be deemed to be waiver of a claim for defective
products, a waiver of the right to reject the goods, and conclusive proof that
the goods (s) were received by Buyer without defect (s).
DISCLAIMER:
Aim High Moonwalks excludes all
remedies or warranties, express or implied, including warranties of
merchantability Aim High Moonwalks disclaims any responsibility whatsoever
to buyer or to any other person for injury to person or damage to or loss of
property or value caused by any product which has been subjected to misuse,
negligence, or accident, or misapplied, or modified or repaired by unauthorized
persons, or improperly installed.
Limitation
of Remedies
Replacement or repair at Aim High
Moonwalks' option shall be the sole remedy of buyer with respect to any
defective or non conforming goods or parts and shall be the exclusive remedy of
buyer, regardless of any remedy otherwise available under applicable law. AHM is
in no way liable for remote, special, speculative, or consequential damage.
AHM is not liable for loss of use or profits under any circumstances due
to any unforseen incidence relating to rental unit.
Cancellation
Policy
Buyer
may cancel his/her order, in whole or in part, upon both verbal and written
notice to Aim High Moonwalks. However, 1/2 down will not be refunded plus any
refund credit card processing fees will be non-refundable.
This is due to covering cost of making the unit upon placing
your order. Payment of cancellation charges, which
charges shall be the sum of (1) the price of all goods that have been delivered
and not previously paid for, plus (2) the actual cost incurred by AHM that
is properly applied to the goods not delivered at the time of decrease or
cancellation, including, without limitation, the cost of components and
materials purchased for use in producing such goods, plus (3) the profit, any
reasonable overhead that AHM would have made from full performance by Buyer,
plus (4) the costs of engineering, prototypes, testing, tooling, and similar
items produced for Buyer, plus (5) the reasonable costs incurred by AHM in
making settlement and effecting collection hereunder. Buyer may require delivery
to it of any material (except tools, molds, dies and any other equipment) for
which payment hereunder is made.
Attorney’s
Fee
In
the event either party brings an action to interpret or enforce its rights under
this Confirmation of Order, the prevailing party shall be entitled to reasonable
attorney’s fees and costs which may be set by the court in the same action, in
addition to any other relief to which it may be entitled.
Limited
Warranty
AHM provides Buyer a limited repair and
replacement warranty and agrees and warrants only that the products, identified
by category below, will be fit for their intended purpose, merchantable, and
without material defect in workmanship and materials for the product specified
as follows:
1)
Inflatable bouncers: Two (2) years from the date of shipment to Buyer.
2)
Parts: Ninety (90) days from date of shipment to Buyer.
3)
Other Equipment: No warranty of any kind is extended by AHM, to the
extent it can legally and contractually do so, assign to Buyer, at Buyer’s
request, all warranties on such other equipment, if any, offered by the
manufactures or suppliers of such other equipment.
A product shall not be considered defective
if it is a different color than shown on our website or in our catalog and no
warranty is made relating to color, digital printing or any airbrushing done on
any unit. All requests of buyer for all warranty work and replacement are
subject to product inspection at AHM's factory. Ordinary wear and tear will not
invalidate AHM's limited warranty, but misuse, improper handling or
storage, improper repairs, improper maintenance and care, lack of ground cover
under inflatable, or accidental, abusive or negligent treatment of the product
will invalidate the warranty. Buyer must use stakes and all tie-down tethers at
all times to insure the safety of users and the equipment. This warranty is not
a guarantee that the product, will not through use, handling and storage develop
tears or punctures from time to time, the repairs of which are the
responsibility of Buyer. Buyer must ship the product(s) designated address
provided by AHM at our expense IF it's a manufactures defect. If the product is evaluated and found
defective, and the warranty for such product is in force within the time
limitations above. All shipping costs will be borne solely by Buyer. No
statement, remark or representation of any employee or agent of AHM may
vary this Limited Warranty unless in writing and signed by the owners of Aim
High Moonwalks.
